General Terms of Business for Emerald Damp Specialists Ltd
1. Introduction

These Terms of Business ("Terms") are set out by Emerald Damp Specialists Ltd ("the Company", "we", "us", or "our") and apply to all services provided by the Company. By accepting our services or receiving a quote, you ("the Client", "you", or "your") agree to these Terms.

2. Services Provided

The Company provides specialist damp proofing, moisture control, and related services ("Services"). Details of the Services to be provided, along with a quoted price, will be outlined in the agreed-upon contract or invoice.

3. Payment Terms

A 50% deposit of the total quoted price is required upfront before any work commences. The deposit is non-refundable once the work has started, except under the conditions set forth in this Agreement. The remaining balance of the total invoice amount is due within 7 days of the completion of the works. Payments can be made via bank transfer, cheque, or other agreed-upon methods.

4. Late Payment Charges

If the outstanding balance is not paid within 7 days of the completion of the works, a late payment charge of 2% of the total invoice value will be applied for each additional 7-day period that the payment remains overdue.Continued failure to settle payment may result in additional legal actions or debt collection procedures.

5. Client Responsibilities

The Client is responsible for ensuring that all areas to be worked on are clear of possessions, furniture, or other items that could obstruct the completion of the work. If the work area is not sufficiently cleared prior to the start of the job, the Company reserves the right to delay the commencement of work until the area is properly prepared. In such cases, any delays caused may impact the overall completion date.

6. Completion of Works

The Company will complete the works as per the specifications in the quotation and agreed-upon timelines, subject to any unforeseen circumstances or delays beyond our control. Any changes or additions to the scope of work will require a written agreement between both parties and may result in adjustments to the quoted price.

7. Liability and Warranty

The Company provides a warranty on the work completed for a period specified in the contract, subject to the Client adhering to proper maintenance guidelines. This warranty does not cover damages caused by neglect, misuse, or natural wear and tear. The Company’s liability for any claim arising from the provision of services is limited to the value of the contract.

8. Termination of Agreement

Either party may terminate the agreement with written notice, subject to any cancellation fees stipulated in the contract. In the case of cancellation by the Client after work has commenced, the deposit will be non-refundable.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which the Company operates. Any disputes will be subject to the exclusive jurisdiction of the courts in that jurisdiction.

10. Amendments

The Company reserves the right to amend or update these Terms at any time. Clients will be notified of any significant changes to the Terms.
